Sunny Outdoors Adventure Waiver and Release of Liability

In consideration for being permitted by Sunny Outdoors (hereinafter "the  Company") to participate in outdoor adventures, including but not limited to  hiking, biking, camping, and other recreational activities, the undersigned  client(s) hereby agree to the following terms and conditions: 

  1. Assumption of Risks: 

I acknowledge and understand that outdoor adventures inherently involve certain  risks and dangers, including but not limited to those associated with natural  conditions, wildlife, weather, terrain, equipment, and the actions or inactions of  others. I am voluntarily participating in these adventures with full knowledge of  these risks, and I assume all risks and responsibilities for any injury, damage, or  loss that may occur as a result. 

  1. Release of Liability: 

I, on behalf of myself, my heirs, assigns, and personal representatives, hereby  release, discharge, and hold harmless the Company, its owners, employees,  guides, and agents from any and all claims, demands, actions, or causes of  action of any kind, whether in law or in equity, arising out of or in connection with  my participation in any outdoor adventure with the Company. This release  includes, but is not limited to, claims for personal injury, property damage, and  wrongful death. 

  1. Indemnification: 

I agree to indemnify and hold the Company harmless from any and all claims,  liabilities, damages, or expenses (including attorney's fees and costs) that may  arise as a result of my participation in the outdoor adventures provided by the  Company. 

  1. Medical Information: 

I certify that I am in good physical condition and have no medical or other health related conditions that could interfere with my ability to participate in outdoor  activities. I understand that it is my responsibility to consult with a physician  before participating if I have any concerns about my physical fitness.

  1. Photographic Release: 

I grant the Company the right to take photographs and/or video recordings of me  during the outdoor adventures and to use these materials for promotional and  marketing purposes without compensation to me. 

  1. Severability: 

If any provision of this waiver and release is deemed invalid or unenforceable, the  remaining provisions shall continue in full force and effect. 

  1. Conflict Resolution: 

Any disputes arising from or related to this waiver and release of liability shall be  resolved through mediation and, if mediation is unsuccessful, through binding  arbitration, in accordance with the rules and procedures of a recognized  arbitration organization. The parties waive their right to a jury trial and any  participation in class actions. Any mediation, arbitration, or legal action must be  filed within one (1) year of the alleged incident. 

  1. Governing Law: 

This waiver and release shall be governed by and construed in accordance with  the laws of the specific country in which the adventure takes place. In the case that the adventure takes place throughout more than one country, this waiver and release shall be governed by and construed in accordance with the  laws of the Republic of Uganda.  

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY  UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO BE BOUND BY ITS  PROVISIONS. I ACKNOWLEDGE THAT I AM SIGNING THIS DOCUMENT  FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND  INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL  LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
